In 2008, the collapse of Lehman Brothers triggered one of the biggest financial market shocks in economic history. As a consequence, MiFID II was adopted in the EU area as a directive, which essentially aims to increase market transparency, customer protection and the governance structures of financial service providers. In Switzerland too, the Swiss Financial Market Supervisory Authority (FINMA) launched a discussion on the protection of financial market clients, which ultimately resulted in the FinSA / FIDLEG.

Admittedly, the FinSA / FIDLEG confronts financial service providers with a whole range of new requirements. It entails high professional and technical requirements for Swiss-domiciled investment advisory clients and MiFID II for EU-domiciled clients. For example, precisely defined information and documentation obligations must be fulfilled, FinSA- /FIDLEG- and MiFID II-compliant client segmentation must be technically implemented, and regulatory-compliant profiling must be carried out. Experience has shown that the real hurdle is not only the interpretation of the regulatory requirements, but above all their effective operational implementation.

The processes to be defined must take into account the fact that the regulatory requirements must be monitored both at the time of the consultation (e.g. during profiling, when preparing the investment proposal or when sending an order) via ad-hoc health checks and over time using a monitoring system.

As part of a larger initiative in overhauling the incentive plan for its employees,
the client wanted to introduce a new compensation model that took country and
market-specific requirements into account. As the project was quite complex and
required significant effort, MMG had a project manager, business analyst and

through certain post trade processes. If correctly implemented, this workflow engine
would significantly reduce the client’s risk that previously resulted from
human errors. MMG thereby provided a team of test management experts to take
over all test management activities related to the successful implementation of
the new workflow engine.
